Effective date: August 22, 2026. This version supersedes all earlier Creative Services Terms.
These Creative Services Terms ("Creative Terms") govern website design and development, graphic design, and branding work ("Creative Services") provided by Artisan Hosting, LLC ("Artisan Hosting," "we," "us") to the client identified in the applicable proposal or statement of work ("Client," "you"). These Creative Terms supplement, and are incorporated into, the General Terms of Service. In the event of a conflict between these Creative Terms and the General Terms as applied to Creative Services, these Creative Terms control. Our Acceptable Use Policy and Privacy Policy are also incorporated by reference.
The specific deliverables, timeline, and price for a given project are set out in a proposal or statement of work ("SOW"). These Creative Terms govern how that SOW works, ownership, revisions, payment plans, and what happens if things change or end early.
1. Deliverables & Revisions
Each SOW describes the deliverables (e.g., a designed and developed website, a logo/brand package, marketing graphics) and the number of structured revision rounds included at each major phase (e.g., design concept, development).
Unless the SOW says otherwise, two (2) rounds of revisions are included per phase. Additional rounds, or revisions requested after a phase has been marked approved, are billed at Artisan Hosting's then-current hourly rate.
"Approval" happens when the Client signs off in writing (including by email) or, if the SOW sets a response window, when that window passes without written objection.
2. Change Orders
Work outside the SOW's described scope, new pages, new deliverables, a materially different direction after a phase is approved, is a change order. Artisan Hosting will describe the additional scope and cost before starting change-order work, and will not proceed without the Client's written go-ahead (including by email).
3. Ownership; Payment-Plan Engagements
3.1 Standard Engagements (Paid in Full or on Delivery)
Except as modified by Section 3.2 for payment-plan Engagements, ownership of the final deliverables (site code, design files, graphics, and other Client Content created for the Client under the SOW) transfers to the Client upon payment in full of the applicable invoice.
3.2 Payment-Plan Engagements
Where an SOW is billed in installments (a payment plan):
During the payment plan, Artisan Hosting retains ownership of the deliverables (including the website's underlying files and source code). The Client receives a limited, revocable license to use, operate, and publicly display the live deliverable (e.g., the published website) for its intended business purpose while payments remain current.
Full ownership, including source files and an irrevocable, perpetual license to everything covered by Section 3.1, transfers automatically upon receipt of the final scheduled payment. No further action is needed on either side for that transfer to take effect.
If a scheduled payment is more than 14 days late, Artisan Hosting may suspend the license described above, including taking the live site offline or restricting access, until the account is brought current. Artisan Hosting will provide notice before doing so where practical.
If the Client cancels or the engagement is terminated before the final payment is made, Artisan Hosting retains ownership of the deliverables produced. At the Client's request, Artisan Hosting will discuss a buyout of the completed work at the remaining contract balance, but is not obligated to hand over source files for unpaid work.
4. Third-Party & Licensed Assets
Some deliverables may incorporate stock photography, fonts, icon sets, plugins, or other components licensed from third parties rather than created from scratch ("Licensed Assets").
Where a Licensed Asset is provided under a license that transfers with the deliverable, it's covered by the ownership transfer in Section 3.
Where a Licensed Asset is provided under a subscription or license held by Artisan Hosting (for example, a stock-photo subscription), continued use after the engagement may require the Client to obtain its own license. Artisan Hosting will identify any such assets in the SOW or at delivery, and can advise on comparable options.
Client-supplied Licensed Assets (fonts, images, etc. the Client provides) remain governed by whatever license the Client obtained for them; the Client is responsible for having the rights needed to use them in the project.
5. Client-Supplied Content
The Client is responsible for the accuracy and legality of any content, logos, images, copy, or trademarks it supplies for use in the project ("Client Materials").
The Client warrants that it owns or has the necessary rights to Client Materials, and to have Artisan Hosting use them as directed.
The Client will indemnify and hold Artisan Hosting harmless from third-party claims arising from Client Materials, consistent with the indemnification provision in the General Terms.
6. Portfolio & Attribution Rights
Unless the SOW or a separate written agreement (e.g., an NDA) says otherwise, Artisan Hosting may display completed work, screenshots, descriptions, and links, in its portfolio, case studies, and marketing materials, and may use the Client's name and logo solely to identify them as a client. The Client may request in writing that a specific project be kept confidential or removed from public materials, and Artisan Hosting will honor that request going forward.
7. Post-Launch Warranty
For 30 days following final delivery/launch, Artisan Hosting will fix, at no additional charge, defects where the delivered work does not function as specified in the approved SOW (broken functionality, display bugs introduced by our work). This warranty does not cover: new feature requests, changes in direction, issues caused by the Client's or a third party's changes after delivery, or issues caused by third-party platforms/plugins outside Artisan Hosting's control. Work outside this warranty is billed as a change order or new engagement.
8. Cancellation
The Client may cancel an SOW at any time on written notice. Artisan Hosting will invoice for work completed and expenses incurred through the cancellation date, calculated on a pro-rata or milestone basis as set out in the SOW.
Ownership of deliverables not yet paid for is governed by Section 3.
Artisan Hosting may decline to begin or may pause a project consistent with the General Terms' engagement-formation provisions (including for non-payment).
9. Relationship to Other Documents
These Creative Terms work alongside the General Terms of Service (engagement formation, confidentiality, limitation of liability, governing law, and other terms of general application), the Acceptable Use Policy, and the Privacy Policy. Where an SOW states specific terms for a project, the SOW controls over these Creative Terms to the extent of any conflict.
